Your Privacy is Important to Us

Privacy Policy

Thank you for visiting this web site (each, a "Site") owned and operated by Berkeley Analytics, Inc. (dba Nutritionquest). ("Nutritionquest"). This Privacy Policy details certain policies implemented throughout Nutritionquest governing Nutritionquest's use of information about users of our Site and the Data-on-Demand (DoD) system available on or through the Site.

We hope that reading our Privacy Policy helps you understand how we collect, use and disclose information on our platform.

About the Data-on-Demand (DoD) System

Nutritionquest offers the Data-on-Demand (DoD) system, which is designed for use by researchers. Researchers direct their study participants to complete questionnaires on the Nutritionquest site. The researchers have access to the information collected by the questionnaire, as well as nutrient and food group estimates which are calculated from the answers respondents provide.

The questionnaire does not collect names, phone numbers, personal addresses, email addresses, and does not store IP addresses. As such, the system does not collect Personally Identifiable Information (PII) or Protected Health Information (PHI). Researchers assign study subjects an identification number (Respondent ID), and we use the Respondent ID as the primary identifier on the data files that researchers can download from the site.

General Description of Information that We Collect

When using our Site, the only information we collect is Non-Personal Information through the use of Cookies. The Nutritionquest site does not collect email addresses or other personal identifiers of people using the site, neither the researchers nor the study subjects.

Non-Personal Information We Collect About You.
The Site may track Non-Personal Information that will be maintained, used and disclosed in aggregate form only and which will not contain your Personally Identifiable Information. For example, without limitation, we may collect the total number of visitors to our Site, the number of visitors to each page of our Site and/or how many users clicked on a certain feature. We may analyze this Non-Personal Information for trends and statistics in the aggregate, and we may use such Non-Personal Information to administer the Site, track users' movement, and gather broad demographic information for aggregate use.

Cookies.
We collect Non-Personal Information about your use of our Web Site through the use of Cookies. Every computer that accesses a Nutritionquest Web site is assigned a different Cookie by Nutritionquest. The information collected by Cookies helps us improve the overall Site experience for our users.

Most browser software can be set to reject all Cookies. Most browsers offer instructions on how to reset the browser to reject Cookies in the "Help" section of the toolbar. If you reject our Cookies, certain of the functions and conveniences of our Site may not work properly. We do not link Non-Personal Information from Cookies to Personally Identifiable Information.

Questionnaire Responses and Research Data
The primary data collected through our Data-on-Demand system are responses to nutrition and physical activity questionnaires. This information is linked only to the Respondent ID assigned by the researcher and does not contain information that could identify the individual respondent. The data collected is used to calculate nutrient, food group and physical activity estimates which are made available to the researchers conducting the study.

Disclosure of Data
The questionnaire data and calculated results are made available to the researcher who is conducting the study. Nutritionquest does not use this data for any other purposes beyond providing the service to researchers.

Children
Some of Nutritionquest's diet and activity questionnaires are specifically designed for children under 13. However, Nutritionquest does not directly collect personally identifiable information from these children. The researcher using our Data-on-Demand system is responsible for enrolling these subjects, seeking consent from the appropriate parent/guardian, and for having their Institutional Review Board (IRB) approve the use of the site for the study subjects. Nutritionquest provides the technical platform and questionnaire tools, but all research protocols, including consent procedures and protections for minors, are the responsibility of the researcher and their institution.

Disclosure of Your Information
Except as described in this Privacy Policy below or as specifically agreed to by you, Nutritionquest will not disclose any information it gathers from you on our Site. We may release information to third parties: (1) to comply with a legitimate governmental agency investigation, law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as in response to a physical threat to you or others, to protect property or defend or assert legal rights. In the event that we are legally compelled to disclose information to a third party, we may attempt to notify you unless doing so would violate the law or court order.

Nutritionquest may transfer information to a successor entity upon a merger, consolidation or other corporate reorganization in which Nutritionquest participates or to a purchaser or acquirer of all or substantially all of Nutritionquest's assets to which this Site relates.

These contractors include suppliers that provide us with technology services for the operation and maintenance of our Site. We also contractually require that our contractors protect the privacy of any information consistent with this Privacy Policy.
